Related Law:
Marriage. Article 8 of Marriage Law of the People's Republic of China: “Both the man and the woman desiring to contract a marriage shall register in person with the marriage registration office. If the proposed marriage is found to conform with the provisions of this Law, the couple shall be allowed to register and issued marriage certificates. The husband and wife relationship shall be established as soon as they acquire the marriage certificates. In the absence of the marriage registration, the man and the woman shall go through the procedures subsequently. Divorce: Article 31 of Marriage Law of the People's Republic of China: “Divorce shall be granted if husband and wife both desire it. Both parties shall apply to the marriage registration office for divorce. The marriage registration office, after clearly establishing that divorce is desired by both parties and that appropriate arrangements have been made for the care of any children and the disposition of property, shall issue the divorce certificates.

Conditions for Acceptance:
Marriage: 1, The registration office has jurisdiction over the registration; 2, Both the man and the woman desiring to contract a marriage shall apply in person to the marriage registration office; 3, Both parties are of legal age to marry (22 for men and 20 for women); 4, Both parties are not directly related by blood, collaterally related within three generations; 5, both the man and the woman desire to contract a marriage. Divorce: 1, Both parties shall apply to the marriage registration office for divorce. 2, Both parties have the full capacity for civil conduct; 3, the parties have a divorce agreement; 4, One party must be a permanent resident of this city; 5, The parties hold marriage certificate issued by a marriage registration office in Mainland China or a Chinese embassy or consulate.

Documentation to Be Submitted:
For Marriage: 1, Related identification cards, certificates or statements that either party has no spouse and that both parties are not directly related by blood, collaterally related within three generations. To be specific: 1.1, for a resident in Ningbo,?1.1.1, the parties’ residence booklet and identification cards; 1.1.2, a signed statement that either party has no spouse and that both parties are not directly related by blood, collaterally related within three generations. 1.2, for a resident in Hong Kong, Macao and Taiwan, 1.2.1, the parties’ valid passes and identity cards; 1.2.2, a statement notarized by a public notary in his place of residence that either party has no spouse and that both parties are not directly related by blood, collaterally related within three generations (valid for 6 months). 1.3, for Chinese personnel sent abroad on duty, and overseas Chinese: 1.3.1, valid passes; 1.3.2, a statement notarized by a public notary in his country of residence and certified by the Chinese embassy to that country that either party has no spouse and that both parties are not directly related by blood, collaterally related within three generations, or a certificate issued by the Chinese embassy (consulate) to that country that either party has no spouse and that both parties are not directly related by blood, collaterally related within three generations (valid for 6 months). 1.4, for a foreign resident: 1.4.1, valid passports or other valid international travel documents; 1.4.2, a statement notarized by a public notary in his country of residence and certified by the Chinese embassy (or consulate) to that country that either party has no spouse, or certificate issued by the Chinese embassy (or consulate) to that country that either party has no spouse (valid for 6 months). 2, documents in a foreign language should have a Chinese translation made by an authorized organization. 3, 3 two-inch half-length, bareheaded and full-faced photos of the two parties. Divorce: 1, Identification certificates: 1.1, the parties’ residence booklet and identification cards;?1.2, for residents from Hong Kong, Macao and Taiwan, the parties’ valid passes and identity cards; 1.3, for overseas Chinese and residents of foreign countries, valid passports or other valid international travel documents. 2, marriage certificates; 3, an agreement on divorce signed by both parties, and the agreement on divorce should state clearly that that divorce is desired by both parties and that appropriate arrangements have been made for the care of any children and the disposition of property and debts; each party should present 2 two-inch half-length, bareheaded and full-faced photos.
